These terms apply to the Pearl Inc. game for iPhone and to the pearl-inc.app website. By using the game, you accept them.

1. Who publishes the game

Pearl Inc. is published by Mathys Hosin, sole trader (entrepreneur individuel), 212 rue de Solférino, 59800 Lille, France, SIREN 994 477 008. Contact: laplateformemjh@gmail.com.

2. The game

Pearl Inc. is a free collection game: you open oysters to find pearls and objects, which you keep in your collection. It runs on iPhone with iOS 18 or later and is downloaded from Apple's App Store.

The licence to use the app is governed by Apple's standard licence agreement (EULA). These terms complement it for the game and its services.

3. Your account

You can play without an account, or sign in with Apple or with your email. You are responsible for the use of your account. You can ask for it to be deleted at any time: see the privacy policy.

4. Chance, in full transparency

The pearl (or object) in an oyster is drawn at random, in advance, when the oyster appears. The odds of each pearl and of finds are shown in the game (Collection and Shop) before any purchase. They never change, neither with a purchase nor with a skin. After 25 oysters in a row without a golden pearl or rarer, the next one is guaranteed to contain one.

Skins are purely cosmetic: they change neither the odds nor the value of pearls.

5. Virtual items

Oysters, gold dust, pearls, objects and skins are game items. You receive a personal, non-transferable right to use them in the game. They have no monetary value: they cannot be exchanged for money, sold, or transferred to another player.

Gold dust is earned by playing (selling duplicate pearls, daily missions) or bought. The price in your currency and what each purchase gives are always shown before you pay.

6. Purchases

In-app purchases are sold and charged by Apple, under Apple's own terms. Oysters and gold dust you buy are added to your game right away. Skins you buy are tied to your Apple ID and can be restored on another iPhone ("Restore purchases").

Purchases give immediate access to digital content. By confirming a purchase, you agree to this immediate supply and acknowledge that you lose your right of withdrawal (French Consumer Code, article L221-28). You can still ask Apple for a refund: reportaproblem.apple.com. Your other consumer rights, including the legal guarantee of conformity for digital content, are not affected.

7. Rewarded ads

The game may offer to watch an ad to earn oysters. It is always optional. The reward is given once the ad has been watched to the end, within the daily limit shown.

8. What is not allowed

If these rules are broken, we may, after warning you where possible, remove advantages obtained improperly or suspend the account concerned.

9. Changes to the game

The game evolves: we may add, change or rebalance features (for example gold dust prices or rewards). The odds shown are always kept up to date. If we ever had to shut the game down, we would tell you at least 30 days in advance and stop selling oysters and gold dust as soon as it is announced.

10. Intellectual property

The game, its artwork, texts, sounds and code are protected. They may not be copied or reused without our permission. iPhone and iPhone Duo are trademarks of Apple Inc.; Pearl Inc. is not affiliated with Apple.

11. Liability

We do our best to keep the game running well, but cannot guarantee it will never be interrupted or have bugs. Nothing in these terms limits the rights the law gives you as a consumer.

13. Disputes

These terms are governed by French law, without depriving you of the protection of the mandatory rules of your country of residence. In case of disagreement, write to us first: laplateformemjh@gmail.com.

14. Changes

If these terms change, we update the date at the top of the page and let you know in the app for an important change.
